1. Scope of application
The following terms and conditions apply to all orders placed via our online shop. Our online shop is aimed exclusively at consumers.
2. Contracting party, conclusion of contract, correction possibilities
The purchase contract is concluded with Primeri GmbH.
The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. You can initially place our products in the shopping basket without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained for this purpose in the order process. By clicking on the order button, you place a binding order for the goods contained in the shopping basket. Confirmation of receipt of your order will be sent by eMail immediately after you have sent the order.
When the contract with us is concluded depends on the method of payment you have chosen (see 5. Payment).
3. Contract language, contract text storage
The languages available for the conclusion of the contract are German and English.
We store the text of the contract and send you the order data and our GTC by eMail. You can also view and download the GTC at any time here on this page. You can view your past orders in our customer login.
4. Delivery conditions
In case, shipping costs are to be added to the stated product prices. You will find more detailed information on shipping costs at our webpage “Shipping & Delivery”.
We deliver only in the dispatch way. Unfortunately, it is not possible to collect the goods yourself.
5. Payment
We offer the following payment methods. Simply choose the payment method that suits you best:
Credit card
Your credit card account will be charged according to the agreements made with the issuing financial service provider.
PayPal
During the ordering process you will be redirected to the website of the payment service provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register first, legitimise yourself with your access data and confirm the payment instruction to us. After placing the order in the online shop, we request PayPal to initiate the payment transaction. The payment transaction will be carried out automatically by PayPal immediately afterwards. You will receive further instructions during the ordering process.
Prepayment
With prepayment, you pay for your order directly and in advance. The invoice for your order will be sent to you separately by eMail. The payment will be processed via the account of Primeri GmbH. Please transfer the total amount due within the next 3 days after receipt of order. Only then will your goods be dispatched:
Recipient: Primeri GmbH
Bank: Berliner Sparkasse
IBAN: DE84 1005 0000 0191 0670 08
BIC: BELADEBEXXX
Reason for payment: your order number or invoice number
Attention: Only transfers with the correct reason for payment can be allocated correctly – thank you!
SEPA Direct Debit (SDD)
We also use PayPal for this payment method (see above): In this case, payment is made via your deposited and there confirmed bank account, i.e. debited from your account by SDD. The current PayPal terms and your agreements with PayPal apply to this procedure.
The prices listed in the respective offers are final prices. They include all price components including any applicable taxes such as VAT. Only in the case of cross-border delivery may further taxes (e.g. in the case of an intra-Community purchase) and/or duties (e.g. customs duties) be payable by you in individual cases, but not to the seller but to the customs or tax authorities responsible there. The delivery and shipping costs incurred are not included in the purchase price; they can be called up via the “Shipping costs” page, are shown separately in the course of the ordering process and are to be borne additionally by you.
6. Reservation of proprietary rights
The goods remain our property until full payment has been received. For customers domiciled in Switzerland, we are entitled to make a corresponding entry in the retention of title register.
7. Transport damage
If goods are delivered with obvious transport damage, please complain about such defects to the delivery company as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.
8. Warranty and guarantees
Information on any additional warranties that may apply and their exact conditions can be found with the product and on special information pages in the online shop.
The following applies to consumers domiciled in Germany and Austria:
Unless otherwise expressly agreed below, the statutory liability for defects shall apply.
The following applies to the purchase of used goods by consumers domiciled in Germany:
If the defect occurs after the expiry of one year from the delivery of the goods, the claims for defects are excluded. Defects occurring within one year of delivery of the goods can be claimed within the statutory limitation period of two years from delivery of the goods.
The above restrictions and shortened periods do not apply to claims based on damage caused by us, our legal representatives or vicarious agents
• in the event of injury to life, limb or health
• in case of intentional or grossly negligent breach of duty as well as fraudulent intent
• in the event of a breach of essential contractual obligations, the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)
• within the scope of a guarantee promise, insofar as agreed
• insofar as the scope of application of the Product Liability Act is opened.
The following applies to consumers domiciled in Switzerland:
They shall inspect the quality of the goods received as soon as this is feasible in the ordinary course of business and, if defects are discovered for which the seller is liable, they shall notify the seller immediately. If the consumer fails to do so, the purchased goods shall be deemed to have been accepted, unless they have defects which were not recognisable during the usual inspection. If such defects are discovered later, the notification must be made immediately after discovery, otherwise the item shall be deemed to have been approved also with regard to these defects.
Send the defective product back to us with a description of the defect. You will bear the transport costs incurred. We provide warranty by rectifying defects. This is done, at our discretion, either by rectifying the defect (subsequent improvement) or by delivering a defect-free item (replacement delivery). If the subsequent performance fails, you are entitled to withdraw from the contract. This does not apply in the case of insignificant defects. A right to a price reduction is excluded.
9. Dispute resolution
The European Commission provides a platform for online dispute resolution, which you can find here. We are willing to participate in an out-of-court dispute resolution procedure before a consumer arbitration board: The competent body is the Universalschlichtungsstelle des Bundes am Zentrum für Schlichtung e.V., Strassburger Strasse 8, 77694 Kehl am Rhein, GERMANY, www.universalschlichtungsstelle.de.
